General terms and conditions of business

1. General

When purchasing from our online shop, you accept the terms and conditions listed below.
These general terms and conditions apply to all deliveries in the version valid and included at the time of purchase.
Conflicting customer conditions are not accepted.

2. View the contract text

You may save or print this document prior to purchase using the usual functionality of your browser. You will receive an invoice by email after each purchase.

3. Sales tax

All items are subject to differential taxation. The proportionate sales tax cannot be shown!

4. Language

Contracts are concluded exclusively in German. For items offered in other languages, the terms and conditions in German apply exclusively.

5. Conclusion of contract

A binding contract comes from the purchase order in the online shop.
In the interests of serious customers, we reserve the right to claim damages and block future purchases in the event of misuse. Therefore, only submit your purchase option if you are sure that you actually want to purchase the item on offer.

6. Article

Unless otherwise stated, all items are used and usually only available once.

7. Description

The description of the individual items is made to the best of our knowledge, and any visible defects and repairs are pointed out. Photos are additional elements of the article description. For used items, no liability is assumed that all original parts are included and/or that the item is repair-free.
If an item does not correspond to the item description and the photos, the right of return (see point 12 of the General Terms and Conditions) comes into force.
The seller must be held harmless and harmless. Costs for reports and expertise requested without the seller’s consent must be borne by the buyer and cannot be enforced.

8. Prices and payment terms

The total price (including the postage costs communicated in the item description or by email)
must be irrevocably booked into our account no later than 14 days after the purchase!
Accepted payment methods:
Cash payment upon personal collection.
Transfers to our bank account must be made in euros by buyers within the EU (even if the purchase in the online shop was made in another currency). When transferring the goods to our bank account, the buyer is responsible for all fees.
Paypal is also available to buyers.
For buyers from the EU there is the option of a fee-free EU transfer (with BIC and IBAN).
When transferring to our bank account, the buyer pays all fees.
The buyer is responsible for all fees (such as bank charges, currency exchange fees).

9. Shipping

Usually sent by Austrian Post or GLS
either as an insured letter or as a package

Insured sums:

Letter Austria up to 70 euros
Letter abroad up to 50 euros
Parcel Austria up to 400 euros
Parcel EU up to 500 euros Parcel

Non-EU after prior agreement if offered by the shipping company (depending on the value of the goods) Insurance only relates to loss of the goods, not to damage.
Refunds in the event of loss will only be granted after the shipping company's investigation has been completed.
In the event of damage in the mail, the buyer must file a claim for costs with his shipping company.
If the item is returned by the shipping company through no fault of the seller and it is necessary to send it again, the buyer must pay new postage costs. (see point 14 of the General Terms and Conditions)

10. Delivery

Delivery usually takes place 2-5 days after receipt of payment.
In the event of work stoppages - particularly strikes and lockouts - or due to force majeure, the delivery time will be extended accordingly. The buyer will be informed immediately of the start and end of such an event.

11. Compensation of value, replacement delivery

If an item is damaged or lost before delivery, regardless of whether the seller is at fault, the purchase price including postage costs will be refunded immediately. Since the items offered are mostly individual items (see point 6 of the General Terms and Conditions), no replacement delivery or value compensation will be made.

12. Withdrawal / return / revocation

The return of the goods (in person or by post) must be announced in writing, by telephone or by email and must be made within 14 days of receipt of the goods in an undamaged, unused condition.
Returns of damaged or used goods by the buyer or the shipping company will not be accepted.
Unless otherwise agreed, postage costs for returns are to be borne by the buyer. Shipments without freight prepaid will not be accepted.
Refund of the purchase price will be made upon return of the item.

13 Warranty

As a used goods store, we only deal in used items. Signs of use are therefore always to be expected and do not give rise to warranty claims. I refer to my item descriptions and the photos.
All items offered (excluding items that have not been inspected,
items that are offered as spare parts or as additional parts)
receive a 12-month warranty on the condition that existed upon handover or delivery.
In the event of damage caused by improper handling, incorrect care, incorrect commissioning (e.g. incorrect current and/or voltage) or damage caused by the shipping company, the warranty claim is void.
When large collections are broken up, not every individual item can be examined in detail
and we have therefore limited our warranty as a dealer to the extent permitted by law.
Within this limited framework, we are of course responsible for deviations from our descriptions and photos.

14. Retention of title

The goods remain our property until full payment has been made.

15. Business Hours

We can be reached by telephone Monday to Friday from 9 a.m. to 6 p.m.
Appointments only during business opening hours.

16. Data Protection

The personal data is stored and used exclusively internally for order processing and for our own advertising purposes in strict compliance with the applicable data protection regulations.
All personal data will be treated confidentially.
Only service partners involved in order entry, processing, shipping and payment receive the data limited to the minimum required.
Otherwise, the general data protection regulations apply.
You can object to the use of data for advertising purposes at any time.

17. Applicable Law

The law of the Republic of Austria applies to all legal transactions with us.
The UN Convention on Contracts for the International Sale of Goods is excluded.

18. Invalidity of provisions

If individual provisions of the delivery contract or these general terms and conditions are ineffective, the remaining provisions remain in effect.
